This paper’s investigation has uncovered a deal that was allegedly ratified unilaterally and/or illegally. Fresh controversy has emerged over the Bea Mountain concession, with allegations that former House Speaker Bhofal Chambers unilaterally extended the agreement outside established legislative procedures. The former Speaker is further accused of signing the Bea Mountain agreement without the consent of plenary, as required under legislative procedure. Legal advocate Macimi Law has described the deal as fundamentally flawed, insisting that “anything that isn’t done rightly isn’t done at all.” Reports indicate that although the Senate passed the concession in 2023, it was never properly reviewed or scrutinized by the full plenary of the House of Representatives before concurrence, raising serious concerns about its legitimacy.
The former Speaker is also said to have signed the Mineral Development Agreement (MDA) without the involvement of fellow lawmakers, many of whom have since confirmed that they were unaware of the process. The Bea Mountain Mining Corporation (BMMC) is now facing renewed scrutiny, with civil society actors calling for the agreement to be declared void. Advocates argue that any deal reached outside proper legal procedures cannot stand, as attention shifts to the government’s next move regarding the controversial concession.
